“Online” purchase contract means the distance contract and that is the legal transaction having as object movable goods and/or services stipulated between a supplier, Valore Italia – Impresa Sociale, Via Luini n.5 Milano MI 2012, and a consumer customer in the context of a distance selling system organized by the supplier who, for this contract, uses the distance communication technology called “internet”. All contracts, therefore, will be concluded directly through access by the consumer customer to the website corresponding to the address: SITE, where, following the procedures indicated, will conclude the contract for the purchase of the goods. The final consumer is the natural person who purchases goods and services for purposes not directly related to the professional activity that may be carried out. Below are the sales conditions that will remain effective until they are changed by the supplier. Any changes to the terms of sale will be effective from the moment they are published on the website and will refer to the sales made from that moment on.
All sales prices of the services displayed and indicated on the website, for which they are offered to the public pursuant to art. 1336 c.c., are inclusive of I.V.A. and any other tax (unless otherwise indicated). Where provided, a transport cost is duly highlighted on the appropriate page within the site that the customer will take care to view before confirming the purchase; in case of delivery abroad will be charged to the consumer any additional costs due to taxes or fees provided for by the law in force in the country of destination. The purchase contract is completed by the exact compilation and consent to the purchase expressed through the “online” date accession. The customer can pay for the goods ordered using only the payment methods indicated online at the time of purchase. Estimated delivery time is N.0 days.
The consumer undertakes and obliges, once the “online” purchase procedure has been completed, to provide for the printing and the preservation of these general conditions, which, moreover, will have already been viewed and accepted as a mandatory passage in the purchase, as well as the specifications of the product under purchase, in order to fully meet the condition of Article. Decr. Legisl. No. 185/1999. The purchaser is strictly prohibited from entering false and/or invented and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively your real personal data and not of third parties, or fantasy. It’s expressly forbidden to make double registrations corresponding to one person or enter data of third persons. The company reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
The consumer who for any reason is not satisfied with the purchase made, has the right to withdraw from the purchase, without any penalty and without specifying the reason, within the period of 10 working days from the conclusion of the contract. The withdrawal must be manifested by sending in the aforementioned deadline of 10 days an email with acknowledgement of receipt to the following address: email@example.com Valore Italia, Via Luini 5 Milano MI 20123. Within the same period, a fax may be sent to the FAX NUMBER to which the aforementioned registered letter with acknowledgement of receipt confirming the withdrawal must be followed within 48 hours. The consumer may not exercise this right of withdrawal itself for products made to measure or clearly customized or which, by their nature, cannot be postponed or are likely to deteriorate or change rapidly. Within the above mentioned period of 10 days must be returned to the sender-supplier all the goods purchased intact and in their original packaging, without any lack. The return costs will be borne by the customer. Once the request is received, the company will send a voucher of equal value to be used within 30 days.
As required by the directive examined in Regulation 524/2013/EU by the European Commission to protect the players who take part in the purchase process on e-commerce, any complaints can be reported on the ODR website.
Valore Italia has the right to terminate the contract of sale stipulated by giving simple communication to the customer with adequate and justified reasons; in this case the customer will be entitled exclusively to the refund of any sum already assumed and paid.
Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated “online” through the website of Valore Italia is subject to Italian jurisdiction; these general conditions are reported, in so far as not expressly provided for therein, the combined provisions of Legislative Decree No. 50 of 15.1.1992 and Legislative Decree No 185 of 22.5.1999. Any dispute between the parties concerning this contract shall be settled by the Customer’s place of residence or the elective domicile of the final consumer ( Art. 1469 Bis N.).
